1. On 11/01/2019, one Mr. Samuel Mathew a journalist met the press at New Delhi. In the press meet a video was released by him. The video contained interviews of one Mr. K.V.Sayan @ Syam and Mr. Valayar Manoj, who are accused in a case of murder of a security guard and robbery that took place on 24/04/2017 at the holiday residence of former Chief Minister Ms. Jayalalithaa, at Kodanadu Estate, The Nilgiris District, Tamil Nadu. In the interview, those accused have claimed that one of the conspirators of the said offence, one Mr. Kanakaraj (since deceased) informed them, during the existence of the conspiracy, that the robbery was committed at the instance of Mr. Edappadi.K. Palaniswami, the incumbent Chief Minister of Tamil Nadu.
2. Certain dates and events, which are relevant to be considered are as follows;-
05/12/2016 Death of Former Chief Minister Ms. J.Jayalalitha
14/02/2017 Mrs.Sasikala (Jayalalithaa’s aide) was convicted by the Hon’ble Supreme Court of India under the Prevention of Corruption Act
15/02/2017 Mrs.Sasikala surrendered before Bangaluru Special Court.
16/02/2017 Mr. EdappadiK.Palanisamy was sworn in as Chief Minister of Tamil Nadu.
24/04/2017 Robbery and murder of Om Bahadur at Kodanad Estate Bungalow of former Chief Minister of J.Jayalalitha.
28/04/2017.08.45 pm Kanakaraj, a former car driver of Ms.J.Jayalalitha and Sasikala, the first accused in the Robbery case died in a Road Accident .
29/04/2017 05.15 pm. Second accused KV. K.V.Sayan @ Syam met with an accident and his wife and daughter died.
04/07/2017 Dinesh Kumar the accountant/ in charge of CCTV cameras, reportedly committed suicide.
11 th January 2019 A2 K.V.Sayan @ Syam says that the robbery was done at the instance of Mr. Edappadi K.Palanisamy as stated by Kanakaraj (A1 since deceased). The conspiracy was to commit the robbery of certain hard discs, pen drives and documents and to be handed over to Mr. Edappadi K.Palanisamy
3. The case relating to robbery and murder at Kodanadu Estate was investigated by the Inspector of Police, Sholururmattam Police Station, Nilgiris District and a final report was filed. The case is now pending for framing of charges before the learned District and Sessions Judge, Nilgiris in Sessions Case No 3 of 2018. The case is posted now on 02/02/2019.
4. The statement of K.V.Sayan @ Syam is implicating Mr. Edappadi K.Palaniswami the Chief Minister of Tamil Nadu fully for the offences under sections 120 B r/w 147,148,149,324,342,447,449,458,395,397,396, and 302 of the Indian Penal Code. The statement reveals that during the existence of conspiracy one of the conspirators (Kanakaraj) told the other accused that Mr. Edappadi K.Palaniswami asked him to commit the robbery. The murder of Mr. Om Bahadur the watchman of the Kodanad Estate was committed during the course of robbery.
5. The statement of K.V.Sayan @ Syam is a material piece of evidence relevant under section 10 of the Indian Evidence Act. It is now well-nigh settled that a further investigation under section 173 (8) Cr.P.C. can be conducted at any time if fresh materials come to surface. It is also well settled that any person against whom materials are available should be brought to justice and everyone is equal before the law.
6. The statement of K.V.Sayan @ Syam whether inspires confidence or not has to be tested only during the trial but that statement certainly provide materials for further investigation under section 173 (8) of Cr.P.C.
7. In normal circumstances, the Investigating Officer would have filed a petition under section 173 (8) Cr.P.C. Since the statement implicates the Chief Minister of the State, the Police department is causing investigation against the persons who released the video and the makers of the statement. It is now reported in the press that the makers of the statement Mr.K.V.Sayan @ Syam and Mr.Valayar Manoj are arrested by the Tamil Nadu police at Delhi, on a complaint given by an AIADMK functionary Mr.Rajsathyan. It is illegal on the part of Tamil Nadu Police, to arrest these persons for allegedly making false statement instead of further investigating the case of murder and robbery at KodaNadu Estate. These people were arrested to suppress the evidence and a clear attempt to cover-up the Crime.
8. Unless a Special Investigation Team is constituted with the officers of the rank of Inspector General of Police, with absolute integrity, the truth behind the grave offences committed at the residence of the former Chief Minister, alleged to have been committed at the instance of the present Chief Minister will never come to light. The further investigation is most required not only to punish the real culprits but also for upholding the honour of the high constitutional office of Chief Minister and to establish the rule of law.
In the above stated circumstances, as the Leader of Opposition and on behalf of the People of Tamil Nadu, I request you to
A. Place all the facts before the Hon’ble President of India to take necessary Constitutional measures
B. Immediately, direct the Chief Minister of Tamil Nadu Mr. Edappadi K.Palaniswami, to demit the office, to pave way for a fair and impartial investigation into the matter.
C. To constitute a Special Investigation Team comprising officers at the rank of Inspector General Police and to conduct further investigation in Sessions case number 3 of 2018 on the file the District and Sessions Judge, Nilgiris.
AND
D. To direct further investigation in to the mysterious death of Mr.Kanagaraj.

11.1.2019 அன்று பத்திரிக்கையாளர் திரு மாத்யூ டெல்லியில் பத்திரிக்கை நிருபர்களை சந்தித்து, அதிர்ச்சிதரும் தகவல் அடங்கிய வீடியோ ஒன்றை வெளியிட்டுள்ளார். அதில் நீலகிரி மாவட்டத்தில் உள்ள முன்னாள் முதல்வர் ஜெயலலிதாவின் ஓய்வு இல்லமான கொடநாடு பங்களாவில் நடைபெற்ற “கொலை மற்றும் கொள்ளை” வழக்கில் குற்றம் சாட்டப்பட்டுள்ள திரு கே.வி.சயன் என்ற ஷ்யாம் மற்றும் திரு வயலார் மனோஜ் ஆகியோரின் பேட்டிகள் இடம்பெற்றுள்ளன. அப் பேட்டியில், தற்போது முதலமைச்சராக இருக்கும் திரு எடப்பாடி பழனிச்சாமி சொன்னதால்தான் கொடநாடு பங்களாவிற்கு கொள்ளையடிக்கச் செல்கிறோம் என்று இந்த சதித்திட்டத்தை தீட்டிய கனகராஜ் (தற்போது இறந்து விட்டார்) தங்களிடம் கூறியதாக அவர்கள் தெரிவித்துள்ளார்கள்.
இந்த விவகாரத்துடன் தொடர்புபடுத்தி மிக முக்கியமாக கவனிக்கப்பட வேண்டிய சில தேதிகளும், நிகழ்வுகளும் இருக்கின்றன. அவை யாதெனில்:
5.12.2016 முன்னாள் முதல்வர் ஜெயலலிதா மரணம் அடைந்தார்.
14.2.2017 லஞ்ச ஊழல் தடுப்புச் சட்டத்தின் கீழான வழக்கில் திருமதி சசிகலா உச்சநீதிமன்றத்தால் தண்டிக்கப்பட்டார்.
15.2.2017 திருமதி சசிகலா பெங்களூர் நீதிமன்றத்தில் சரண்டரானார்.
16.2.2017 திரு எடப்பாடி பழனிச்சாமி முதலமைச்சராக பதவி ஏற்றார்.
24.2.2017 முன்னாள் முதல்வர் ஜெயலலிதாவின் கொடநாடு பங்களாவில் காவலாளி ஓம் பகதூர் கொலை செய்யப்பட்டு,கொள்ளையடிக்கப்பட்டது.
28.4.2017-8.45 PM: கொடநாடு கொள்ளை வழக்கில் முதல் குற்றவாளியும், முன்னாள் முதல்வர் ஜெயலலிதாவின் கார் ஓட்டுநருமான கனகராஜ் கார் விபத்தில் மரணம் அடைந்தார்.
29.4.2017-5.15PM: கொடநாடு கொள்ளை வழக்கில் இரண்டாவது குற்றவாளியான கே.வி. சயன் என்ற ஷ்யாம் சென்ற கார் விபத்திற்குள்ளாகி, அவரது மனைவியும், மகளும் இறந்து விட்டார்கள்.
4.7.2017 கொடநாடு பங்களாவில் சிசிடிவி ஆப்பரேட்டராகவும், அக்கவுண்டன்டாகவும் இருந்த தினேஷ் குமார் தற்கொலை செய்து கொண்டதாக தெரிவிக்கப்பட்டது.
11.1.2019 கொடநாடு பங்களாவில் உள்ள கம்ப்யூட்டர் ஹார்டு டிஸ்க்ஸ், பென் டிரைவ்ஸ், டாக்குமென்டுகள் போன்றவற்றை எடுத்து திரு எடப்பாடி பழனிச்சாமிக்கு கொடுப்பதற்காகவும், அவர் சொன்னதின் பேரிலும் பங்களாவில் கொள்ளையடித்ததாக இரண்டாவது குற்றவாளியான ஷ்யாம் என்ற சயன் வாக்குமூலம் கொடுத்த வீடியோ வெளியானது.
நீலகிரி மாவட்டத்தில் உள்ள சோளூர்மட்டம் காவல் நிலைய ஆய்வாளர் கொடநாடு பங்களா “கொள்ளை மற்றும் கொலை” வழக்கினை விசாரித்து, நீதிமன்றத்தில் இறுதி அறிக்கை தாக்கல் செய்துள்ளார். தற்போது இந்த வழக்கு (“செசன்ஸ் கேஸ் 3/2018”) நீலகிரி மாவட்ட செசன்ஸ் நீதிமன்றத்தில் விசாரிக்கப்பட்டு வருகிறது. வழக்கின் அடுத்த விசாரணை வருகின்ற 2.2.2019 அன்று நடைபெறுவதாக அறிவிக்கப்பட்டுள்ளது.
சயன் என்ற ஷ்யாம் கொடுத்துள்ள வாக்குமூலத்தில் இந்திய தண்டனைச் சட்டம் 120 r/w 147,148,149,324,342,447,449,395,397,396 and 302 போன்ற பிரிவுகளின் கீழ் உள்ள வழக்கிற்கு எடப்பாடி திருபழனிச்சாமியே முழுக்காரணம் என்ற ரீதியில் குற்றம் சாட்டியிருக்கிறார். அதில் எடப்பாடி திரு பழனிச்சாமிதான் கொள்ளையடிக்கச் சொன்னார் என்று சதித் திட்டத்தில் உடந்தையாக இருந்த கனகராஜ் தன்னிடம் சொன்னதாகவும் சயன் கூறியிருக்கிறார்.
சயன் என்ற ஷ்யாம் வாக்குமூலம் முக்கியமான ஆதாரம் மட்டுமின்றி இந்திய தண்டனைச் சட்டப் பிரிவு 10-ன்படி வழக்கிற்கு “தொடர்புடைய” (Relevant) ஆதாரமும் ஆகும். ஒரு வழக்கில் புதிய தகவல்கள், ஆதாரங்கள் கிடைத்தால் குற்றவியல் விசாரணை நடைமுறைச்சட்டப் பிரிவு 173 உட்பிரிவு 8-ன் கீழ் எந்த நேரத்திலும் “மேல் விசாரணை” (Further Investigation) நடத்தலாம் என்பது தெளிவான சட்ட விதிமுறை. அதே போன்று யாருக்கு எதிராக புதிய ஆதாரங்கள் வெளிவந்தாலும் அவரை சட்டத்தின் முன்பு நிறுத்த வேண்டும் என்பதும், சட்டத்தின் முன்பு அனைவரும் சமம் என்பதும் கூட தெளிவான சட்ட நடைமுறையாகவே இருந்து வருகிறது. ஆகவே ஷ்யாம் என்ற சயன் கொடுத்துள்ள வாக்குமூலம் மேல் விசாரணைக்கு உகந்ததாகவும், குற்றவியல் நடைமுறைச் சட்டப்பிரிவு 173(8)-ன் கீழ் நடவடிக்கை எடுப்பதற்கு ஏற்றதாகவும் இருக்கிறது.
இது போன்று புதிய ஆதாரங்கள் வெளிவரும் போது வழக்கமாக அந்த வழக்கின் புலனாய்வு அதிகாரி மேற்கண்ட பிரிவின்கீழ் மேல் விசாரணை செய்வதற்கு சம்பந்தப்பட்ட நீதிமன்றத்தில் மனு போட்டிருக்க வேண்டும். ஆனால் வெளிவந்துள்ள ஆதாரங்கள் முதலமைச்சருக்கு எதிராக இருப்பதால், அந்த வீடியோவை வெளியிட்டவர்கள் மீதே வழக்குப் போட்டு காவல்துறை விசாரித்துக் கொண்டிருக்கிறது. வாக்குமூலம் கொடுத்த சயன் மற்றும் வயலார் மனோஜ் ஆகியோரை அதிமுக நிர்வாகி ராஜ் சத்யன் என்பவர் கொடுத்த புகாரின் அடிப்படையில் டெல்லியில் தமிழக காவல்துறை கைது செய்திருப்பதாக பத்திரிக்கைகளில் தற்போது செய்தி வந்துள்ளது. கொடநாடு கொள்ளை மற்றும் கொலை வழக்கில் மேல் விசாரணை நடத்துவதற்கு பதில் “பொய் வாக்குமூலம் கொடுத்தார்கள்” என்று கூறி இந்த இருவரையும் தமிழ காவல்துறை கைது செய்திருப்பது சட்டவிரோத செயலாகும். ஆதாரங்களை அழிக்கவும், குற்றத்தை மறைக்கவும் தமிழக காவல்துறை இப்படி கைதுகளை அரங்கேற்றிக் கொண்டிருக்கிறது.
ஆகவே நேர்மையான ஐ.ஜி. தலைமையில் ஒரு சிறப்பு புலனாய்வுக்குழு (Special Investigation Team) அமைத்து முன்னாள் முதல்வர் இல்லத்தில் இந்நாள் முதல்வர் சொன்னதன் பேரில் நடந்துள்ளதாக குற்றம் சாட்டப்படும் கொள்ளை குறித்து தீவிர விசாரணை நடத்தினால் மட்டுமே, கொடநாட்டில் நிகழ்ந்த கொடிய குற்றத்தின் உண்மை பின்னனி வெளியில் வரும். உண்மை குற்றவாளிகளை தண்டிக்க மட்டுமின்றி- சட்டத்தின் ஆட்சியை நிலைநாட்டவும்- முதலமைச்சர் பதவிக்குரிய கண்ணியத்தை காப்பாற்றவும் இந்த குற்றச்சாட்டுகள் மீது “மேல் விசாரணை” நிச்சயம் நடத்தப்பட வேண்டும்.
ஆகவே தமிழக எதிர்கட்சி தலைவர் என்ற முறையிலும், தமிழக மக்களின் சார்பாகவும் இந்த தருணத்தில் மாண்புமிகு தமிழக ஆளுநர் அவர்களை கேட்டுக்கொள்வது யாதெனில்,
1. முதலமைச்சர் எடப்பாடி திரு பழனிச்சாமி மீது கூறப்பட்டுள்ள கொலை குற்றம் குறித்து குடியரசுத் தலைவருக்கு தெரிவித்து, அரசியல் சட்டப்படி எடுக்க வேண்டிய நடவடிக்கைகளை மேற்கொள்ள வேண்டும்.
2 பாரபட்சமின்றியும், நேர்மையாகவும் விசாரணை நடைபெற எடப்பாடி திரு பழனிச்சாமியை முதலமைச்சர் பதவியிலிருந்து விலகுமாறு அறிவுறுத்த வேண்டும்.
3. நேர்மையான ஐ.ஜி. தலைமையில் ஒரு சிறப்பு புலனாய்வுக்குழுவை ஏற்படுத்தி, நீலகிரி மாவட்ட செசன்ஸ் நீதிமன்றத்தில் நிலுவையில் உள்ள வழக்கு எண் “செசன்ஸ் 3/2018”ல் தற்போது வெளியாகியுள்ள வீடியோவில் உள்ள புதிய ஆதாரங்களின் அடிப்படையில் மேல் விசாரணை (Further Investigation) நடத்துவதற்கு உத்தரவு பிறப்பிக்க வேண்டும்.
4. கனகராஜின் மர்ம மரணம் குறித்து மேல் விசாரணைக்கு உத்தரவிட வேண்டும்.
